Terms of Use - Tester

Minimum Age

You confirm you are at least 18 years old. If you are younger, do not register or take tests; UserTest Pro may disregard tests and deny payment for underage participants.

One Account Only

You may maintain only one Tester account. Duplicate accounts will be removed along with any associated payments; repeated violations may lead to permanent ban.

Registration Data

To register, you provide accurate, authentic, and complete personal information, including demographic details (age, gender, state, city, date of birth) and a valid UPI ID for payouts.

Independent Contractor

You acknowledge that you are an independent contractor, not an employee, partner, or agent of UserTest Pro. Nothing in this agreement creates an employment relationship.

Notification

You agree to be notified by email and via push notification (Android app) when a test matching your demographics and screener responses is available.

Acceptance

Tests are assigned on a first-come, first-serve basis; accept promptly to secure the test. Declining or missing an invitation does not penalize your rating but may reduce earning opportunities.

Device Requirements

You must use the specified device(s) (desktop browser or Android app; iOS app). Ensure your environment meets any minimum OS or browser requirements indicated in the instructions.

Equipment

A working microphone and stable internet connection are required. Use a quiet environment, enable Do Not Disturb mode, and close unrelated applications to prevent interruptions.

Test Conduct

• Follow instructions exactly without deviating.
• Use the think-aloud protocol: continuously verbalize expectations, confusion, and reactions.
• Do not provide real sensitive information (credit cards, passwords); use dummy credentials when required.
• Only use emulators or accessories if explicitly directed in the test instructions.

Completion

Upload the complete recording (screen + audio) before the test deadline. Incomplete or corrupted uploads may result in no payment.

Technical Issues

If you encounter technical problems during a test, attempt troubleshooting first (restart app/browser, check permissions). If unresolved, notify support immediately via support@usertestpro.com with your test ID. Depending on timing, the test may be reassigned; unresolved failures may affect payment and rating.

Payment Method

Payments are made weekly via UPI every Friday. To be included in the Friday payout, you must submit recordings before the weekly cutoff at 5 PM IST on Friday.

Payment Fees

Any transaction fees or charges associated with UPI transfers are your responsibility and deducted from the payment total.

Unpaid Tests

Tests deemed incomplete, unclear, or non-compliant (e.g., missing continuous feedback, poor audio, wrong screen, interruptions) are not eligible for payment.

Payment Disputes

If you believe a qualified test was unfairly rejected, you may email support@usertestpro.com with detailed reasons to dispute the decision.

Automatic NDA Agreement

By participating in any tests, you automatically agree to these confidentiality and NDA terms without separate signature.

Scope of Confidentiality

• All tests, recordings, associated information, client details, and any Elements under test are strictly confidential.
• You shall not use, disclose, or share any such information with any third party unless the information is publicly available or UserTest Pro has expressly granted written permission.

Duration

This confidentiality obligation applies during your engagement and continues indefinitely after termination.

Potential Penalties

Any breach of confidentiality may result in immediate termination of your Tester account, forfeiture of payment for the test, and possible legal action. UserTest Pro may pursue damages for losses caused by unauthorized sharing of test materials.

In addition, in the event of a breach of these confidentiality obligations, you agree to pay liquidated damages of INR 100,000, which the parties agree is a genuine pre-estimate of the loss likely to be suffered. UserTest Pro may also seek actual damages if those exceed INR 100,000.

You agree to comply with any additional confidentiality agreements or NDAs required by UserTest Pro or its clients to safeguard sensitive information.

Ownership of Test Results

You assign and agree to assign all rights in and to Test Results (feedback, suggestions, improvements) to UserTest Pro for no additional consideration.

UserTest Pro may use anonymous statistics and aggregated non-personally identifiable information from your tests for internal analytics, service improvement, marketing, or other purposes.

Test Content Ownership

All recordings, feedback, and suggestions you provide in tests are owned exclusively by UserTest Pro or the commissioning client, as directed.

License to Platform

You grant UserTest Pro a non-exclusive, worldwide, royalty-free license to use your recordings and feedback solely to provide and improve Services and for marketing purposes (anonymized or with consent).

No Reuse Rights

You waive any rights to reuse or distribute test recordings or feedback outside UserTest Pro.

Personal Data Usage

Your personal identifying information (name, email) is used solely for platform operations (matching, notifications, payments) and is never shared with clients beyond what is necessary (and only if explicitly agreed).

Marketing Consent

By registering, you consent that anonymized or aggregated feedback may be used for marketing. To opt out, email support@usertestpro.com. Opting out does not affect test participation or payment.

Data Retention and Deletion

UserTest Pro retains your personal data and recordings only as long as necessary to fulfill the purposes outlined or as required by law. You may request deletion of your personal data at any time; upon deletion, your data and recordings are purged, except anonymized aggregates already published.

Termination by Tester

You may delete your account at any time via the dashboard; no refunds apply for unused tests.

Suspension/Termination by UserTest Pro

UserTest Pro may suspend or terminate your account for:

• Breach of these Terms (e.g., confidentiality breach, submitting fraudulent or low-quality tests).
• Failure to comply with platform instructions.
• Underage participation or multiple accounts.
• Other misconduct or legal requirements.

Additional Note

In such cases, UserTest Pro may provide notice or take immediate action if necessary to protect confidentiality or security.

Effect of Termination

Upon termination, you must cease using platform materials. UserTest Pro may remove your test data after a retention period as per policy. Confidentiality obligations survive indefinitely.

"AS IS" Provision

The Services and any content are provided "AS IS" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Tester Representations

You represent that you have the legal right to provide your services and feedback and that your test conduct and content do not infringe third-party rights or violate laws.

Limitation of Liability

UserTest Pro shall not be liable for any damages except where directly caused by UserTest Pro's gross negligence or intentional misconduct in handling your personal data. Neither party is liable for incidental, indirect, or consequential damages arising from the Services.

Governing Law

These Terms are governed by the laws of India.

Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, India.

Amendments

UserTest Pro may revise these Terms at any time by updating this posting. Continued use of the platform constitutes acceptance of revised Terms.

Independent Contractor Status

You and UserTest Pro are independent parties; nothing herein creates an employment relationship or partnership.

Severability

If any provision is held invalid, the remainder shall continue in effect.

Entire Agreement

These Terms, along with the Privacy Policy and other applicable policies, constitute the entire agreement between you and UserTest Pro regarding testing services.
